Trade Mark registration Process: |
|
The process to register a trade mark in
India starts with the checking of the mark with a view to ascertain that it
will be allowed registration and no other similar mark is registered or
applied for. This exercise assumes a very important role as even a minor
error judgemental or otherwise can mar all the efforts to register a trade
mark. Its a very detailed process which should be undertaken by the expert
attorney. Once we are in a position to determine the
availability or otherwise of the trade mark, we can go ahead with the trade
mark application. After filing the application trade mark
office grants a TM number to each application which will become registration
number after registration of the mark. Now a days Trade Mark registry has started
giving the examination report within one month of the application filing. If
the application is not objected by registry , the mark is advertised in trade
mark journal. If there is no opposition to the mark
within 4 months of the publication in trade mark journal, Registrar grant registration
to the mark. Registration is now a days granted within
6-8 months where there is no objection or opposition to trade mark
application. |
Trademark objection or Trademark Opposition
If your trade mark application has been objected by Trade Mark Registry
or opposed by any other person, THE APPLICANT HAS TWO OPTIONS i.e.:
Option 1- To file the reply to Examination Report or to File Counter Reply to the Opposition
Option 2- To get the application examined by the Experienced Attorney
who will advise the registrability or otherwise of the trademark applied. In
other words, trademark applicant should ensure whether it is prudent to defend
the objection or opposition. As defending the objection or opposition involves
big litigation cost, it is always better to get the application re-examined to
ensure that trademark shall be registered even after spending too much
money.
